CALIFORNIA - After nearly 5 days of trial, US court judges said Samsung Electronics had to pay $ 539 M to Apple Inc. for a case of mimicking the patented feature of the iPhone.
Both of these smartphone giants manufactures have been fighting in court since 2011, in the same case that Apple sued Samsung has plagiarized its smartphone product.
The new court ruling was based on a trial in San Jose, California that focused on how much money Samsung had to pay Apple for infringing patents in terms of design.
Compensation covers five design patents and utilities. The decision came after repeat trials of compensation took years and had also been brought to the US Supreme Court. The patent dispute between Apple and Samsung began in April 2011, when Apple alleges that some types of Samsung smartphones imitate the iPhone. Therefore, Samsung is considered to infringe on iPhone patents and trademarks.
Apple won its case in August 2012 and was given a compensation worth $ 1 B. But Samsung questioned the amount of compensation that must be paid. Samsung argued the number of damages should be $ 28 M, while Apple insists on $ 1 B
But finally agreed Samsung will pay half of the total. Following the announcement of a court ruling, Apple issued a statement to praise the jury and confirmed that Samsung "blatantly plagiarized Apple's design", Samsung responded to Apple's statement saying the ruling was against the previous Supreme Court ruling. "We will consider all efforts to get results that do not hamper creativity," said Samsung.
